Welcome to lostandthenfound.com ("we," "our," "us"). Our online store is hosted on Shopify Inc., which provides us with the e-commerce platform to sell our products to you. By accessing our website, purchasing our items, or engaging with our services, you agree to be bound by the following Terms of Service.

1. Nature of Antique and Vintage Goods
 • As-Is Condition: All items sold on our store are antique, vintage, or pre-owned. They naturally exhibit signs of wear, patina, aging, and minor imperfections. Every item is sold strictly in "As-Is" condition.
• Accurate Descriptions: We make every effort to provide detailed photos and accurate descriptions of item conditions, dimensions, and history. However, these descriptions are subjective statements of opinion and do not constitute a formal guarantee or legal warranty.
• Color Variation: Actual colors may vary slightly due to individual screen calibrations, digital rendering on the Shopify platform, and photographic lighting.

2. Pricing, Taxes, and Payments
• Currency: All prices are processed in USD and exclude applicable taxes and shipping fees, which are calculated automatically at checkout based on your location.
• Price Corrections: We reserve the right to correct any accidental pricing errors or inventory inaccuracies. If an item is listed at an incorrect price, we reserve the right to cancel the order and issue a full refund before shipment.
• Payment Processing: Payments are securely processed through Shopify Payments and authorized third-party gateways (e.g., PayPal). Orders will not be processed or shipped until funds are fully cleared.

3. Shipping, Insurance, and Fragile Delivery
• Carrier Methods: Due to the fragile and irreplaceable nature of antiques, items are shipped via trackable, insured carriers.
• Shipping Insurance: Full shipping insurance is mandatory and factored into your checkout shipping quote to protect against loss or damage in transit.
• Customs and Duties: For international orders, the buyer is entirely responsible for all customs duties, import taxes, and brokerage fees required by their local government.

4. Cancellation and Return Policy
• Return Window: Online orders qualify for a strict 7-day return window starting from the recorded delivery date provided by the carrier tracking. Returns accepted only for gross description errors.
• Eligibility Criteria: Returns are only accepted if the item was significantly misrepresented in our listing. We do not accept returns for buyer's remorse, minor color variations, or natural wear typical of an item's age.
• Return Conditions: To receive a refund, items must be shipped back in the exact same condition as they were sent. Any unauthorized alterations, deep cleaning, or damage caused post-delivery will void the refund.
• Shipping Costs: The buyer is responsible for all return shipping costs, using the same insured, tracked carrier method by which the item arrived. Original shipping fees are non-refundable.
• Cancellations: Cancellations are only accepted until order is fullfilled. 

5. Claims for Damaged Shipments
• Immediate Notification: If an item arrives damaged from transit, you must notify us via email within 48 hours of delivery.
• Required Documentation: You must provide clear photographs of the damaged item, the internal packaging materials, and the exterior shipping box to validate an insurance claim with our carrier. Do not discard any packaging materials until the claim is processed.

6. Accuracy of Billing and Account Information
• We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
• In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

7. Limitation of Liability
• To the maximum extent permitted by law, lostandthenfound.com and Shopify Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of our website or the purchase and subsequent use of any antique items.

8. Governing Law
• These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of CO/USA.
